The relatives of Na’onche Osborne, the murdered adopted child of former Nevada state senator Pat Spearman, have initiated a legal case against the North Las Vegas casino where he was tragically shot earlier this year. The lawsuit, initially covered by KLAS-TV/Las Vegas, accuses the Aliante Casino and Hotel of negligence regarding its security measures.

According to prosecutors, 23-year-old Osborne was shot on March 27 inside the Aliante by 20-year-old Aerion Warmsley, who currently faces charges of murder and auto theft in both state and federal courts.

While Warmsley awaits his hearings, Osborne’s biological mother is seeking justice, asserting that the casino neglected its responsibility to safeguard its patrons.

Willecia Calhoun, who claims to be the administrator of her son’s estate, alleges that Aliante failed to provide “adequate security for its guests, visitors, and the community” and also lacked “a sufficient presence of security personnel in visible locations to deter criminal activity.”

The lawsuit claims that the shooting was “reasonably foreseeable” and is seeking compensation that exceeds $15,000, which is the standard minimum in Nevada civil cases.

Records from the grand jury reveal that Warmsley and another accomplice spent a considerable amount of time in a stolen vehicle near the casino prior to the shooting, having interacted with a security officer on two separate occasions.

In spite of those interactions, Osborne was subsequently shot inside the casino.

The civil case is requesting a jury trial and has asked the court to schedule a trial date. Concurrently, Warmsley has a status hearing set for December 2 in Clark County District Court, with his federal trial expected to commence in January.

Boyd Gaming, the company that manages Aliante, has chosen not to provide any comments regarding the ongoing legal matter.
